Personal Data and General Confidentiality Agreement

This Personal Data and General Confidentiality Agreement (“Agreement”) explains how BengalCloud International (“BengalCloud”, “we”, “us”, or “our”) collects, processes, stores, and protects personal data, and how confidential information is handled.

By using our services, you (“Client”, “User”, or “you”) agree to the terms outlined below.

• Full name
• Email address
• Phone number
• Billing and payment information
• IP address and device data
• Account login details
• Any other information provided during registration or support

4.2 Billing Information

Payment related details required for processing invoices and transactions.

5. Purpose of Data Collection

Both BengalCloud and the Client agree:

• To take reasonable measures to prevent unauthorized disclosure

12. Exceptions to Confidentiality

Confidentiality obligations do not apply where information:

• Is publicly available
• Is required to be disclosed by law
• Is already known without obligation of confidentiality
• Is disclosed with prior consent

13. Data Breach and Incident Response

In case of a data breach affecting personal data, we will take reasonable steps to:

• Investigate the incident
• Secure affected systems
• Notify affected users when appropriate
• Comply with applicable legal requirements

14. Third Party Services

Our services may integrate with third party providers. We are not responsible for the privacy practices of third party services, and users should review their respective policies.

15. Limitation of Liability

BengalCloud shall not be held liable for:

• Unauthorized access caused by user negligence
• Data loss due to client-side misconfiguration
• External attacks beyond our reasonable control

16. Governing Law

This Agreement shall be governed by the laws of Bangladesh.

17. Updates to This Agreement

We may update this Agreement at any time. Continued use of our services constitutes acceptance of any revised terms.

18. Acceptance

By using BengalCloud services, you acknowledge that you have read, understood, and agreed to this Personal Data and Confidentiality Agreement.
